What Indiana Law Treats as a Speed Contest

Indiana Code § 9-21-6-1 prohibits engaging in a motor vehicle speed contest on a highway or street. The statute focuses on whether a contest occurred, so proof that a driver exceeded the posted limit may not resolve the central legal issue. The state must present proof that supports the conduct charged under the statute.

Indiana Code § 9-21-6-2 separately addresses placing a barricade or obstacle across a highway or street to facilitate or accompany a motor vehicle speed contest. Under Indiana Code § 9-21-6-3, a violation of the chapter is generally classified as a Class B misdemeanor, subject to statutory exceptions. That criminal classification distinguishes the allegation from an ordinary speeding citation.

Evidence in an Indianapolis Street Racing Case

An accused driver may need to address both the criminal proceeding and separate BMV concerns. Court dates, charging documents, prior traffic history, and any suspension or agency notice should be reviewed together.
