Most license reinstatement cases in Indianapolis trace back to an OWI conviction, a chemical test refusal, or a Habitual Traffic Violator (HTV) designation built on alcohol-related offenses. How the Indiana BMV Reinstatement Process Works

The starting point is your Official Driver Record (ODR). The Reinstatement Requirements section of your ODR shows the earliest reinstatement date and every outstanding condition the BMV requires before driving privileges can be restored. Fees vary by suspension type and are listed in the Suspension Information section of your ODR.

How those conditions get satisfied depends on the type of suspension. For court-ordered suspensions, the court must transmit documentation to the BMV directly. For insurance suspensions, your insurance provider must electronically submit a Certificate of Compliance or SR-22 certificate of financial responsibility to the BMV. Neither can be submitted by you as the driver. An SR-22 maintained for 180 consecutive days without a lapse resolves an insurance suspension. For OWI-related and certain other court-ordered violations, the SR-22 must remain on file with the BMV for three years.

One caution worth stating plainly: driving before all requirements are satisfied and your ODR reflects an active status can result in new criminal charges. Getting the sequence right matters.

Common Causes of License Suspension in Indiana

The type of suspension on your record determines which reinstatement path applies. The most common suspension types we see involve the following:

OWI Conviction Suspensions

Operating while intoxicated (OWI) convictions carry mandatory suspension periods tied to the number of offenses. Under Indiana Code 9-30-5-10, a first OWI offense results in a suspension of 90 days to 2 years. A second offense carries 180 days to 2 years. A third or subsequent offense can result in a 10-year suspension. Each offense level has distinct reinstatement conditions.

Chemical Test Refusal

Refusing a chemical test triggers a separate administrative suspension under Indiana law, independent of any criminal conviction. Under Indiana Code 9-30-16-1, chemical test refusal generally bars a driver from obtaining Specialized Driving Privileges (SDP), though certain exceptions apply. HTV Designation

A Habitual Traffic Violator (HTV) designation results from accumulating a defined number of qualifying violations within a 10-year period. The designation carries a 5- or 10-year suspension depending on the offense category. Driving while suspended as an HTV can result in a Level 6 felony charge and additional suspension consequences.

Insurance Suspensions

Failure to maintain proof of financial responsibility leads to an insurance suspension. Resolving it requires your insurance provider to submit an SR-22 or Certificate of Compliance electronically to the BMV. Drivers can’t submit this documentation themselves.

Specialized Driving Privileges (SDP) in Indiana

Driving Privileges allow a suspended driver to drive for limited purposes while the underlying suspension remains in effect. Permitted uses typically include employment, medical appointments, and transporting children, subject to court-ordered conditions.

To obtain SDP, you must file a verified petition with the court. Courts can impose conditions including restricted hours, designated routes, or an ignition interlock device. Under Indiana Code 9-30-16-1, drivers who refused a chemical test are generally barred from SDP, though exceptions exist. Drivers who never held an Indiana license may also face additional limitations.

SDP isn’t full reinstatement. The underlying suspension remains in place, and violating any condition the court sets can result in revocation of the privileges. Petition errors are common, and attorney assistance can improve the likelihood that yours is approved with conditions that are workable for your daily life.

Lifetime Suspension Rescission Under Indiana Law

Courts stopped ordering lifetime suspensions after 2014, but all previously ordered lifetime forfeitures remain in effect. If you were designated before that change, you may be eligible to petition for rescission under Indiana Code 9-30-10-14.1.

Eligibility & Waiting Period

Under Indiana Code 9-30-10-14.1(b), you may petition to rescind a lifetime suspension if it was entered at least 10 years before the petition is filed and you have no HTV Category A convictions. If the lifetime suspension was based solely on a conviction for driving while suspended as an HTV, the waiting period under subsection (f) is three years rather than ten.

What the Petition Must Include

The petition must be verified by you and include the following:

Personal identifying information
How the lifetime suspension was originally ordered
A statement that the required waiting period has passed
A description of how circumstances have substantially changed since the suspension was imposed
An explanation of why reinstatement would benefit society

Where to File & Who Must Be Served

The petition is filed in the circuit or superior court of the county where you live. If you live out of state, it is filed in the county of your most recent Indiana moving violation conviction. The prosecuting attorney in the county of filing, the BMV, and the Attorney General must all be served with a copy of the petition.
